Terms of Service

These Terms of Service ("Terms") are an agreement between you and JSG Travel Tools Inc., doing business as Allpacko ("Allpacko," "we," "us," or "our"). They govern your use of the Allpacko iOS application, website, beta releases, and related services (collectively, the "Services"). By using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1. Eligibility and accounts

You must be at least 13 years old to create an account. If you are under the age of legal majority where you live, a parent or legal guardian must consent to your use. Parents and guardians are responsible for managed traveler profiles and for minors using the Services under their supervision.

• You must provide accurate information and use a phone number you are authorized to use.
• You are responsible for access to your device and account and must promptly notify us of suspected unauthorized use.
• You may not impersonate another person or create an account for another person without authorization.

2. The Services and beta releases

Allpacko helps people create trips, build and reuse packing lists, assign items, coordinate with family or trip participants, and track packing progress. Features may change as we improve the Services.

TestFlight and other prerelease versions are provided for testing. They may be incomplete, contain errors, change without notice, or result in loss of data. You may provide feedback, and we may use that feedback without restriction or compensation to improve Allpacko. TestFlight use is also subject to Apple's TestFlight terms.

3. Family groups, trips, and invitations

• Organizers control their family groups and trips and are responsible for inviting the correct people and assigning appropriate access.
• Information added to a shared family or trip is visible to other participants according to their role.
• Before providing another person's phone number, you must have permission to use it for an Allpacko invitation or traveler record.
• You may not use invitations or notifications for spam, harassment, marketing, or any unrelated purpose.

4. SMS and notifications

Allpacko sends one-time authentication codes and user-requested invitations by SMS. Message frequency varies and message and data rates may apply. Reply STOP to stop supported non-authentication messages or HELP for assistance. Authentication messages are necessary when you choose phone-number sign-in. Carrier delivery is not guaranteed.

Push notifications are optional and can be managed in the App and in iOS Settings.

5. Your content

You retain ownership of content you submit. You grant Allpacko a worldwide, non-exclusive, royalty-free license to host, copy, process, transmit, and display that content only as needed to operate, secure, and improve the Services and make it available to the people with whom you share it.

You represent that you have the rights necessary to submit your content. You are responsible for your content and for resolving disputes about content shared within your family or trip.

6. Acceptable use

You may not:

• Use the Services unlawfully or violate another person's rights.
• Access or attempt to access another user's account or non-public data without authorization.
• Upload malicious code, disrupt the Services, evade security controls, or probe for vulnerabilities without written permission.
• Abuse invitations, send unsolicited messages, harass others, or submit unlawful or harmful content.
• Scrape, automate access to, reverse engineer, or copy the Services except where applicable law expressly permits it.
• Resell, sublicense, or commercially exploit the Services without our written permission.

7. Purchases and subscriptions

Some features may require an in-app purchase or auto-renewable subscription. The App will show the price, billing period, included features, and any trial before purchase. Apple processes payments under your Apple Account. Subscriptions renew unless canceled at least 24 hours before the end of the current period and can be managed or canceled in your Apple Account settings. Apple's policies govern billing, refunds, and payment disputes. Deleting Allpacko does not automatically cancel a subscription.

8. License and intellectual property

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Services for their intended purpose. Allpacko and its software, branding, design, and non-user content are owned by JSG Travel Tools Inc. or its licensors and are protected by law.

For an App obtained through Apple, the Apple Standard Licensed Application End User License Agreement also applies to the license of the App. If these Terms conflict with that agreement regarding the App license, the Apple agreement controls for that subject.

9. Privacy

Our Privacy Policy explains how we collect, use, and disclose information. By using the Services, you acknowledge those practices.

10. Third-party services

The Services depend on Apple, TestFlight, telecommunications carriers, and other service providers. Their separate terms may apply. We are not responsible for third-party services, outages, or content outside our control.

11. Suspension, termination, and deletion

You may stop using the Services at any time. You may request account deletion as described in the Privacy Policy. We may suspend or terminate access when reasonably necessary to protect users or the Services, comply with law, prevent fraud or abuse, or address a material breach of these Terms. Where appropriate, we will provide notice and an opportunity to resolve the issue.

12. Disclaimers

To the fullest extent permitted by law, the Services are provided “as is” and “as available.” Allpacko disclaims implied warranties, including merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or completely secure, or that packing suggestions will be complete or suitable for every trip. Allpacko is a planning aid; you remain responsible for travel documents, medication, safety equipment, and other critical items.

Some jurisdictions do not allow certain disclaimers, so some of the above may not apply to you.

13. Limitation of liability

To the fullest extent permitted by law, JSG Travel Tools Inc. and its officers, employees, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or loss of data, profits, goodwill, or opportunities, arising from the Services. Our aggregate liability for claims relating to the Services will not exceed the greater of $50 or the amount you paid Allpacko during the 12 months before the event giving rise to the claim.

These limitations do not apply where prohibited by law and do not limit rights that cannot legally be waived.

14. Changes and governing terms

We may update these Terms as the Services or law changes. We will post revised Terms, update the date above, and provide additional notice when required. Changes apply prospectively. If you do not agree to revised Terms, stop using the Services.

Applicable law governs these Terms without overriding mandatory consumer protections available where you live. If part of these Terms is unenforceable, the remaining provisions remain in effect. These Terms, the Privacy Policy, and any applicable Apple terms are the complete agreement concerning the Services.
